Bonus Points Terms of Use
These Bonus Points Terms of Use (the “Terms”) form an integral part of the Loyalty Program of Expert Food Limited Liability Partnership (hereinafter - the “Seller”) and establish the procedure for accrual and use of Bonus Points on the Seller’s Platform.
The Customer accepts these Terms by joining the Seller’s Loyalty Program.
1. Terms & Definitions
All capitalized terms used herein shall have the following meanings:
Platform - a software component enabling remote sale of food products, prepared meals, beverages, and other related goods via the Internet, available at:

Platform Owner - the party granting the Seller a non-exclusive license to use the Platform under a separate agreement.
Bonus Points - a virtual unit of value granting the Customer the opportunity to receive a discount. Bonus Points have no monetary equivalent and cannot be exchanged for cash.
Promotion - a marketing activity the conditions of which provide the Customer with the right to receive incentives, including Bonus Points. The terms of each Promotion are published on the Platform and/or in the Personal Account.
Goods - food products, prepared meals, beverages, and other related items, including accompanying services such as delivery.
Loyalty Program - the set of rules governing participation in the Seller’s loyalty program.
Personal Account - the Customer’s personal page on the Platform used to access Platform functions.
2. General Provisions on Bonus Points
2.1. Bonus Points may be granted to the Customer as an incentive within promotional campaigns conducted by the Seller, within its loyalty programmes, as well as in other cases at the Seller’s discretion (including, for example, for the purpose of maintaining the Customer’s loyalty to the Platform).
2.2. Each Customer has a Bonus Account. Information about the account is available in the Personal Account.
2.3. Unless expressly stated otherwise, when purchasing Goods via the Platform, the Customer may apply Bonus Points to receive a discount at the rate of 1 Bonus Point = 1 tenge discount.
2.4. The number of Bonus Points available for use on each Good is fixed and calculated automatically based on the total number of Bonus Points available to the Customer, including applicable limitations.
Bonus Points are applied automatically in the amount calculated by the system.The Customer may choose either to use the points or to opt out of applying them altogether.
2.5. The following limits apply to the redemption of Bonus Points:
2.5.1. Bonus Points may be used to obtain a discount of up to 99% of the Goods price; however, the minimum amount payable by the Customer for each Goods shall be no less than 1 tenge.
2.5.2. Promotions may set additional limits on redemption of Bonus Points awarded within that Promotion. The Seller shall notify the Customer of such limits by posting information on the Platform and/or in the Personal Account, or via electronic communication using the Customer’s contact details.
2.6. Bonus Points cannot be used to receive discounts on specific categories of goods (works, services, property rights) where restrictions are established by the Seller within Promotions.
2.7. Bonus Points accrued improperly or in error shall be subject to cancellation.
3. Cancellation of Bonus Points
3.1. The Seller may cancel Bonus Points without prior notice if there are grounds to classify the Customer’s actions as abuse of rights (Art. 8 of the Civil Code of Republic of Kazakhstan) or if the Bonus Points were obtained through fraudulent or otherwise unlawful actions.
3.2. If an order is canceled for any reason after Bonus Points have been awarded, such Bonus Points will be deducted from the Customer’s Bonus Account.
3.3. In case of return of poor-quality Goods, the number of Bonus Points previously used toward payment shall be re-credited to the Customer’s Bonus Account. Bonus Points shall be re-credited within 3 business days following the return of the Goods.
3.4. Bonus Points awarded for incentive purposes for purchases within a specified period and not used by the Customer within that period shall be canceled.
3.5. Bonus Points may be canceled if unused by the Customer for three weeks or more (“expiration” of Bonus Points).
4. Other Provisions
4.1. The Seller may amend these Terms at any time by posting the updated version on the Platform and/or in the Personal Account. The Customer may review the current version of the Terms at any time.
4.2. The Customer’s actions confirming acceptance of these Terms, accrual or use of Bonus Points, participation in Promotions, and use of Bonus Points on the Platform and/or in the Personal Account constitute acknowledgment and acceptance of these Terms.
4.3. All notices, messages, and other information under these Terms shall be provided to the Customer on the Platform and/or in the Personal Account, or via electronic communication using the Customer’s contact details.
